Promoter

  1. This competition ("Competition") is conducted by TAL Life Insurance Services Limited (“TLISL” or “Promoter”) ABN 31 003 149 157 AFSL 233728 of Level 16, 363 George Street, Sydney NSW 2000. TLISL is part of the TAL Dai-ichi Life Australia Pty Limited ABN 97 150 070 483 group of companies (“TAL”).

Acceptance of terms and conditions 

  1. Instructions and information with respect to this competition form part of these terms and conditions. All terms and conditions apply to all entries and/or prizes.
  2. All entry instructions and prize information published by the Promoter form part of these conditions. By entering this competition, eligible entrants accept the terms and conditions as outlined in this document.

Eligibility

  1. The Competition is open to individuals who:
  1. are Australian residents aged 18 years or older at time of entry;
  2. at the time of competition entry and throughout the Competition Period, have a valid postal address;
  3. successfully submit the webform as determined by the Promoter;
  4. Have a current in-force insurance product with the Promoter throughout the competition period;
  5. who meet all other conditions for eligibility to participate in the Competition as set out in these terms and conditions,

    collectively, an (“Eligible Entrant”). 
  1. By entering the Competition, entrants agree to be bound by these terms and conditions. In case of any inconsistency between these terms and conditions and any other published material, these terms and conditions prevail.

Entry

  1. The Competition Period commences at 12:00am AEDT on 29 July 2024 and closes at 11.59pm AEST on 30 September 2024 ("Competition Period”). 
  2. Competition entry commences at 12:00am AEDT on 29 July 2024 and closes at 11.59pm AEST on 30 September 2024 ("Entry Period”). 
  3. To enter the Competition, a participant in the competition must, during the Entry Period:
    1. Submit a completed webform (via the instructions provided via letter or email); and
    2. Be an Eligible Entrant, 
       
      collectively, an (“
      Eligible Entry”).


  4. Entries must be received by the Promoter during the Entry Period.  Entries will be deemed received at the time that the Promoter is satisfied that all necessary requirements under these terms and conditions have been met. 

  5. It is the entrant’s responsibility to notify the Promoter should their contact details change during the Competition Period.

  6. There is no fee to enter this competition.

Prizes draws and winner announcements

  1. During the Competition Period, Eligible Entrants, who the Promoter is satisfied meet all necessary requirements under these terms and conditions will be entered into the draw for the chance to win a prize.

  2. There will be a total of five (5) winners in the prize draw who will each win a $500 MasterCard E-Gift Card which will be delivered by email.

  3. The maximum retail value of all Prizes is $2,500.

  4. Eligible Entrants must provide their correct telephone and email and update the Promoter if it changes before the draw occurs by calling us on 1300 537 699.

  5. The draw will occur on 7 October 2024 (“draw date”) at 363 George Street, Sydney, NSW 2000.

  6. The draw will occur via software and will be drawn at random as selected by an employee of the Promoter.

  7. Winners will be notified by telephone and email within 2 business days of the draw date, and the Winner’s first initial, last name and state will be published at www.tal.com.au/TLISL-terms-and-conditions from the date of the Draw for at least 30 days.

  8. If a winner does not respond to the phone call and email prior to 7 January 2025 they will forfeit their prize.

  9. The Promoter accepts no responsibility for a winner who does not read or access or respond to any telephone call or email notifying that they were the successful winner.

  10. The $500 MasterCard E-Gift Card(s) (the “prize”) are issued by EML Payment Solutions Limited (the “Supplier”) ABN 30 131 436 532 AFSL 404131.

  11. Details about redeeming the prize are subject to the terms and conditions of the supplier.

Unclaimed prize draw

  1. If any prizes remain unclaimed after two attempts to contact the winner via the methods specified in condition 18 above a subsequent draw will occur on 7 January 2025 at 363 George Street, Sydney, NSW 2000.
  2. The new winner(s) (if any) will be notified or attempted to be notified by telephone and email as per condition 18 above.If a new winner does not respond to the telephone call or email prior to 7 February 2025 they will forfeit their prize.
  3. The Promoter accepts no responsibility for prizes lost, misplaced or otherwise not delivered to a winner or not claimed by the winner or who does not activate the Card within three months of receiving it (via delivered email).

  4. The Promoter will not provide a replacement prize or cash for any prize not activated.
  5. Prizes cannot be transferred, exchanged or redeemed for cash.

  6. The Promoter’s decision on any aspect of this Competition is final and binding.

  7. Correspondence regarding the Competition will be entered into at the express discretion of the Promoter.

Fulfilment details

  1. In the event that a winner does not accept delivery of their Prize in accordance with any conditions of delivery notified to them at the time of redemption, then the Prize will be forfeited, and cash will not be awarded in lieu.

  2. TLISL takes no responsibility for the Prize being lost, stolen, not redeemed within the three (3) months of receipt of the email or undelivered due to an issue with the recipient’s email mailbox.

General terms

  1. The Promoter reserves the right to request recipients of the prize to provide proof of identity, and/or proof of offer eligibility in order to claim the Prize. Proof of identification, residency and eligibility considered suitable for verification is at the discretion of the Promoter and will have regard to any legal requirements applicable. In the event that suitable proof cannot be provided, the Prize will be forfeited in whole, and no substitute offer will be made.

  2. The Promoter reserves the right to disqualify (and not provide the prize to) anyone who tampers with the Competition (including the eligibility process) at the absolute discretion of the Promoter. Tampering includes but is not limited to an entrant who:

    1. Games or attempts to game or structure Policy applications or entries into the Competition with the intention of claiming multiple Prizes not within the terms or intent of this Competition;
    2. Submits an entry that is not in accordance with these terms and conditions; or
    3. Has (in the Promoter’s opinion) engaged in conduct in participating in the Competition which is fraudulent, misleading, deceptive or manipulative, or which is generally damaging to the goodwill or reputation of the Promoter or any of its related body corporates.


  3. If, for any reason, this Competition is not capable of running as planned, including due to computer technical failures; fraud; delays in fulfilling material obligations where such delay is due to industrial action, fire, flood, war, public disaster, delay in transportation; or other causes beyond the control of the Promoter, which affects the administration, security, fairness, integrity or proper conduct of this competition, then the Promoter will endeavour to provide a reasonable alternative Competition (but has no obligation to do so and has no obligation to continue the Competition beyond the periods set out in Conditions 6 and 7).

  4. The Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition to the extent permissible by law, and subject to any written directions from a regulatory authority.

  5. The Promoter may cancel the Competition at any time, subject to any written directions from a regulatory authority.

Limitation of liability and variation of terms 

  1. If any act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations.

  2. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this Competition, the promotion of this competition or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promoter.

Entry details and privacy 

  1. Entry details remain the property of the Promoter. The names and state of a prize winner may be used for promotional purposes by the Promoter unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this Competition for the purposes of updating contact information, facilitating the conduct of the Competition and awarding any prizes. Without limiting the foregoing, entrants' personal information provided in connection with this competition will be handled in accordance with the Promoter's Privacy Statement, visit www.tal.com.au/privacy to obtain a copy.
